When cases involve serious felonies it is safe to assume that you are dealing with a level of prosecutor, you’re dealing with a level of law enforcement, normally a detective, that have substantial experience handling those type of cases. This isn’t their first rodeo.
They’ve normally had decades of experience prosecuting cases, bringing them to court, dealing with the different evidentiary issues. As such, you would be remiss in failing to acknowledge the fact that they are going to be exhaustive, which means that they are going to talk to everybody they can.
The most common scene is, especially with criminal cases, is they want a confession. They want the confession. I
t doesn’t matter how many other materials they have or what other facts they have, they want the defendant, oftentimes on video or being recorded or taped, they want that person saying, “I did it.”
It doesn’t mean that they’re going to give up there. They’re going to talk to the witnesses on the scene. They may talk to family members.
They may get subpoenas to look at the technology that we have whether it’s an iPhone or a mobile device, an iPad, a computer at home. They may look at tweets. They may look at FaceBook postings or LinkedIn postings. They’re going to be exhaustive in nature. They’re going to be thorough.
