Modified Transcript of “Keeping Legal Secrets Secret” for the Hearing Impaired
Commentary by lawyers on public venues, such as on some social media, specifically about certain cases is just now allowed.
We’re just not allowed to disclose certain confidences and trust me there are times I wish we could because we can be a target for things.
- Attorney – Client Privilege
- Public Policy
- Courts Benefit from Clients Telling Their Attorney the Truth
- Common Law Protection
- Confidences Cannot Be Divulged
What we want to do and what our goal and desire and our duty is, is to protect confidences and to keep things private and frankly secret and so when you consult with a lawyer, and this comes from over four hundred years of jurisprudence, they call it attorney-client privilege.
What you tell your lawyer is meant to be kept secret because the courts, our system, our social fabric wants to make sure that your lawyer hears all the facts and that those fact, whether they’re good or bad, are kept in confidence and not used against them.
Nothing’s more frustrating, at least to me, is to have a client tell me two of the three facts and they leave out the third fact because they’re embarrassed, or they think it will hurt their case, and have that come back on us to the detriment of the client. It doesn’t help to keep out facts that hurt your case. In fact it hurts you.

It doesn’t help to worry that your lawyer is going to judge you, and that you’re a bad person, or you’re a bad client.
I’ve heard everything. I’ve heard terrible, terrible sets of circumstances and our job is to look at the things without a jaundiced eye, without judging people, and give frank honest answers about what we think we can do to help you.
