What is Precedence? What is Legal Precedent? What Has Happened in the Past?
The question is what is precedence, meaning what has happened beforehand. That really applies to a couple different areas.
First there’s something called case law. When you talk to a lawyer and they refer to precedence they’re referring to what an appellate court has said.
The appellate court reads the law as the legislature sets forth. They look at the constitution and they read what other judges have said about the lawyer, the constitution and the facts, and they apply that. That’s precedence.
There’s also this concept of what’s happened in the past, just how things happen in court, meaning when you’re dealing with the district attorney.
- What in the past have they been willing to do for people?
- Can you remind them of cases that were similar that the state lost?
- Does the state remind you of cases that were similar where they won?
It’s more than just looking in the law books or the appellate opinions.
It’s knowing the community, the standards, what has worked or not worked at trial, what do juries agree with or not agree with.
