Conditional Restoration of Driving Privileges

Following a Restoration Hearing, the Driver License Section of NC DMV sets forth conditions. The following materials are edited for ease of reviewing online and are intended as legal reference materials.

Additional, supplemental conditions for restoration may apply in your matter. Furthermore, DMV may require compliance with an Addendum for Conditional Restoration.

North Carolina Division of Motor Vehicles

The conditional restoration of driving privilege is made between the North Carolina Division of Motor Vehicles (Division) and the licensee, with licensee’s consent, where the name and address is as follows:

The undersigned licensee agrees and consents to a restoration of driving privilege making the licensee eligible to hold a North Carolina driver license subject to all applicable statutes of Chapter 20, Article 2, and the following conditions:

  • The license restored hereunder shall be a Classified C license
  • Licensee promises and agrees that he will under no circumstances drive or operate or attempt to drive operate any motor vehicle upon the public streets, highways or public vehicular areas after having consumed any type of alcoholic beverages, drugs or other impairing substances
  • Licensee promises and agrees to submit to any blood tests or breath tests upon a valid request by any law enforcement officer
  • The Licensee shall at no time during this restoration be found by the Division to have become an excessive user of alcohol, drugs, or impairing substances
  • Not be convicted of or plead guilty or nolo contendere to any motor vehicle moving violation, drug or alcohol violation occurring prior to this date which was not divulged to the Hearing Officer at the time of the hearing
  • The licensee shall surrender the driver license and this restoration shall be terminated upon receipt of a civil revocation under N.C.G.S. 20-16.5 a violation of the Alcohol Concentration restriction under N.C.G.S. 20-19(c3) and/or a violation of the Ignition Interlock Restriction under N.C.G.S. 20-17.8 during the period of conditional restoration
  • Not be convicted of or plead guilty or nolo contendere to any liquor or drug law offense
  • The licensee agrees and consent to appear upon 10 days written notice at a hearing by the Division to determine if the terms and conditions of this agreement have been violated and understands that failure to appear is a violation of this agreement
  • Only operate a vehicle properly equipped and maintained with an Ignition Interlock Device approved by the North Carolina Division of Motor Vehicles
  • Not violate any policies, procedures or requirements of the Ignition Interlock program
  • The licensee shall surrender the driver license and this restoration shall be terminated upon any conviction for any offense resulting in a suspension of driving privileges, or upon the accumulation of as many as six (6) points pursuant to N.C.G.S. 20-16
  • The licensee understands, consents and agrees that a violation of any term, restriction or condition of this agreement shall result in termination of this restoration and the license continues in the original state of revocation
  • Not violate any provisions of N.C.G.S. 20-24.1 or N.C.G.S. 20-4.20
  • This restoration shall be effective on 02/29/2042, and shall expire at 12:01 A.M. on 02/29/2043 unless the Division terminates the restoration sooner as provided above
  • Licensee understands, consents and agrees that licensee will not seek and the Division will not grant a restoration for a period of four years from termination if this agreement is terminated for any drug or alcohol violations or for a period of twelve months if this agreement is terminated for any other violation
  • Licensee agrees and understands that his agreement shall not prohibit the cancellation, suspension or revocation of driving privileges under any other provision of the Motor Vehicle Laws and will not reduce the length of time that Ignition Interlock is required according to N.C.G.S. 20-17.8(c)
